A Beacon for Legal Minds: The Forest Stewardship Council's Call for a Trademark & IP Counsel

The Forest Stewardship Council (FSC), a globally revered non-profit organization dedicated to promoting sustainable forestry, is actively seeking a dedicated and experienced Legal Counsel specializing in Trademark & Intellectual Property. This pivotal role, based in the vibrant international city of Bonn, Germany, offers a unique opportunity for legal professionals to leverage their expertise in a mission-driven environment. Far from a conventional corporate legal position, this role places you at the heart of global sustainability efforts, safeguarding the integrity of a brand that stands for environmental stewardship and responsible resource management worldwide. For legal experts passionate about intellectual property and its strategic application in a global context, this opening with FSC represents not just a job, but a chance to contribute meaningfully to the planet's future.

Protecting the Planet's Promise: The Critical Role of Intellectual Property at FSC

In an increasingly interconnected world, where brand recognition and trust are paramount, the protection of intellectual property (IP) is a cornerstone for any organization, especially one with the global reach and ethical mandate of the FSC. The FSC's distinctive trademarks and certification labels are not merely symbols; they are powerful assurances to consumers, businesses, and NGOs that products originate from responsibly managed forests. This trust is built upon rigorous standards and a robust enforcement mechanism, which is precisely where the Legal Counsel (Trademark & IP) steps in.

The core responsibility of this role is to act as the vigilant guardian of FSC’s global trademark and intellectual property portfolio. This involves navigating complex legal landscapes across multiple jurisdictions, ensuring that the FSC brand, its logos, and certifications are used correctly, protected from infringement, and defended against misuse, fraud, and counterfeiting. The strategic importance of this function cannot be overstated; without strong IP protection, the credibility of FSC's certification system could be undermined, jeopardizing its mission to promote environmentally appropriate, socially beneficial, and economically viable management of the world's forests.

This position offers a rare blend of proactive strategy and reactive enforcement. It's about more than just legal compliance; it's about preserving the very essence of what FSC represents. The Legal Counsel will be instrumental in shaping the organization's global brand protection strategy, providing clear legal guidance, and supporting enforcement actions that resonate across continents. This involves a deep understanding of international IP laws, a keen eye for detail, and the ability to collaborate effectively with a diverse array of stakeholders, from internal teams and Network Partners to certification bodies and external counsel.

The scope of responsibilities for the Legal Counsel Trademark & IP at FSC is comprehensive and dynamic, reflecting the global nature of the organization's operations. Candidates will be expected to:

Lead Global Trademark Enforcement: This entails spearheading efforts to combat unauthorized use, infringement, and counterfeiting of FSC trademarks across various international jurisdictions. It's a proactive role requiring strategic thinking and decisive action.

Investigate and Address Misuse: From identifying fraudulent activities to tackling unauthorized trademark usage, the counsel will be the first line of defense, ensuring the integrity of the FSC brand remains uncompromised.

Draft and Negotiate Enforcement Documentation: This includes crafting cease-and-desist letters, negotiating settlement agreements, and preparing other critical legal documents to resolve IP disputes efficiently and effectively.

Support Litigation Strategies: Where disputes escalates, the counsel will play a crucial role in developing and supporting litigation strategies, coordinating closely with external legal counsel to achieve favorable outcomes.

Collaborate with Authorities: Working hand-in-hand with customs authorities, regulators, and law enforcement agencies is essential to combat large-scale counterfeit and fraudulent operations, requiring strong diplomatic and collaborative skills.

Advise on Broad IP Matters: Beyond trademarks, the role extends to advising on copyright, domain names, e-commerce issues, and unfair competition, providing holistic IP guidance to internal stakeholders.

Contribute to Global Trademark Strategy: The counsel will actively participate in the development, implementation, and continuous improvement of FSC’s global trademark strategy and portfolio, ensuring it remains robust and adaptable to evolving legal and market landscapes.

Provide Business-Oriented Legal Advice: This involves offering practical, solution-oriented legal advice to internal teams, including support for licensing and contractual matters, balancing legal risk with business needs.

Deliver Training and Guidance: Educating internal and external stakeholders on trademark compliance and brand protection awareness is a key preventative measure, fostering a culture of IP respect.

Conduct Legal Research and Monitor Developments: Staying abreast of relevant regulatory changes and legal precedents is vital for supporting governance improvements and strategic initiatives within the Legal Department.

Forging Your Path: Essential Credentials for a Distinguished IP Career with FSC

To excel in this challenging yet rewarding role, candidates must present a robust legal background and specialized experience. A university degree in Law (LL.B., LL.M., Juris Doctor, or equivalent) is the foundational requirement.
