Handle First Party Property litigation involving either the corporation and/or its insured within established corporate guidelines and the applicable code of professional responsibility.
Handle First Party Property files and issues of a more complex nature with higher levels of dollar exposure and requiring less oversight.
Communicate with client regarding file status and progress.
Analyze files as litigation progresses as well as risk to the company.
Evaluate cases and seek settlement as necessary.
Draft all necessary pleadings, papers and briefs to advance litigation activities at the trial or appellate level.
Conduct necessary research in support of drafting activities.
Advocate client position in all forums (state and federal court, alternative dispute resolution, administrative tribunals and regulatory hearings) and circumstances, both formal and informal.
Negotiate effectively in the resolution of all issues.
Stay current on state statutes and court decisions and analyze how statutes and court decisions affect the interpretation and enforceability of the various policy provisions.
Demonstrates expertise in First Party Property litigation, including drafting pleadings, conducting research, and advocating client positions in various forums. Possesses strong knowledge of tort, contract, and insurance law, along with a commitment to professional responsibility.
